Terms and Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Promotion is only open to Australian residents aged 18 years or over who have access to a printer and a digital camera. Employees (and their immediate families) of the Promoter or Yahoo!7 Pty Ltd ("Yahoo!7"), and agencies associated with the Promoter or Yahoo!7, are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries (including an entrant's identity, occupation, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. "Registration Period" means the period commencing on Mon 18.08.08 and concluding at 11.59pm AEST on 07.09.08, unless terminated earlier by the Promoter in its absolute discretion. To be eligible to enter the promotion, entrants must first register their details during the Registration Period. Entrants who register during the Registration Period will be added to a list to receive the Project briefs via email as soon as they are launched. The first 200 entrants to register during the Registration Period will be sent a free PIXMA Creative Pack valued at $70 RRP. Winners will be notified by email. Total prize pool of the Registration Period is $14,000.
5. To actually take part in the competition entrants must complete the provided Project briefs and upload their entries through the upload section of the site run by Flickr (www.flickr.com). Entrants will need to have a valid Flickr account and Flickr ID. If they are not currently a Flickr member they can register for free via the "Register and upload" links provided on the competition website.
6. Each entrant may only register once. Only one registration is permitted per household. Only one registration is permitted per email address.
7. "Upload Period" is the period in which registered entrants may participate in the promotion. The promotion will have four (4) Upload Periods, each corresponding to a "Project". Registered entrants will receive an email containing the Project brief for each Upload Period on the start dates set out below. To enter each Project, entrants must follow the instructions set out in each brief (including taking a photograph containing the elements set out in the brief), visit (INSERT WEB ADDRESS), follow the prompts to the upload page, complete all requested details including uploading a photo in accordance with the Project brief), and submit the completed entry. The upload website will be moderated by Flickr. Each photo submitted must be in accordance with the Flickr Terms of Use and Community Guidelines (see www.flickr.com). To be considered eligible for Major Prizes or Runner-Up prizes entrants will need to ensure that their entries are (submitted within the Upload Periods specified below for each of the Projects. Entries submitted past the closing date of an Upload Period for a Project will not be considered for that Project's Major or Runner-Up prize, however they will be eligible to be considered for the Grand Prize of $20,000 cash.

8. Photos submitted and accepted for each Project will be displayed in the competition website gallery. All uploaded photos will be vetted by the Promoter. The Promoter reserves the right, at any time, to remove any material from the website that it deems, in its absolute discretion, to be obscene, offensive or inappropriate, or infringing upon the rights of any third party, including, but not limited to, copyright, and to subsequently disqualify any entrant that uploads such material.
9. Images should be (a) a minimum of 500 x 500 pixels and as a guide no smaller than 500kb with a maximum file size of 10MB; and (b) of an acceptable resolution and picture quality, as determined by the Promoter in its absolute discretion. Each entry will be required to meet the specified criteria of each Project to constitute a valid entry. It is the individual's responsibility to make sure that they adhere to the directions given in the brief and the Promoter will take no responsibility for any photographs that have been uploaded incorrectly. Entrants are required to retain a copy of any photographs submitted in the highest resolution possible.
10. Multiple entries are permitted, subject to the following: (a) each entrant may submit a maximum of 3 entries per Project (b) no more than 3 photos may be uploaded per entry (c) each entrant is permitted an overall maximum of 36 photos uploaded across all 4 Projects; and (d) each entry must be submitted separately and in accordance with the Project brief.
11. This promotion is a game of skill. Each entry will be individually judged based on artistic and creative merit by a panel of judges appointed by the Promoter. This judging process will take place for each of the individual projects as listed below:
Project 1: Judging Tue 23/09/08 to Fri 26/09/08
Project 2: Judging Tue 14/10/08 to Fri 17/10/08
Project 3: Judging Tue 4/11/08 to Fri 7/11/08
Project 4: Judging Tue 25/11/08 to Fri 28/11/08
Grand Prize: Judging Mon 1/12/08 to Wed 3/12/08
12. The judges' decision is final and no correspondence will be entered into.
13. The best valid entry in each Project, as determined by the judges, will win the Major Prize for that Project, consisting of: a PIXMA MP970 printer, EOS 450D single lens kit DSLR camera, a SELPHY CP770 compact photo printer with KP361P paper and ink pack, an IXUS 80IS silver compact digital camera and an A4 50 sheet pack of Pro photo paper. Total value of each Major Prize is $2,532 RRP. There are 4 Major Prizes in total.
14. The next 4 best valid entries in each Project, as determined by the judges, will each win a Runner-Up Prize consisting of: a PIXMA Creative Pack and a PIXMA MP610 printer. Total value of each Runner-Up Prize is $370 RRP. There are 16 Runner-Up Prizes in total.
15. All entries will be recombined and re-judged to determine the Grand Prize winner. The overall best entry received, as determined by the judges, will win $20,000 cash, to be awarded in the form of a cheque made out to the winner.
16. Total prize pool for the game of skill is $36,048.
17. Winners of the Project Major, Runner-Up and Grand Prizes will be notified by Flickr ID and Email and will be announced post judging on the below dates:

18. Each entrant warrants to the Promoter that: (a) each entry submitted (including photograph) is an original artistic work of the entrant that has not been entered in or won any previous contents or awards, and does not infringe the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal or proprietary rights, or violate any applicable law or regulation; and (b) he or she will obtain the consent of any recognisable person that is featured in a photograph to submit the photograph and for it to be used as outlined in these terms and conditions. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of these warranties. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
19. As a condition of entering into this promotion, each entrant grants the Promoter a non-exclusive license to use their entry in any media for an unlimited time for the purpose of conducting the current and future promotions, including publishing the entries on the competition website.
20. It is a condition of accepting a prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
21. In participating in the prizes, each winner agrees to participate and co-operate as required in all editorial activities relating to the Promotion, including but not limited to being interviewed and photographed. Each winner hereby grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs and the winners will not be entitled to any fee for such use.
22. Incomplete, indecipherable, or illegible entries will be deemed invalid. The Promoter reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these Terms and Conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions will not be entered into. Images that are considered unlawful or contain objectionable content, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable will not be acceptable and will be deemed invalid by the Promoter in its absolute discretion.
23. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions of any regulatory authority.
24. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash unless otherwise specified.
25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant or voter; or (b) subject to any written directions of any regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
26. Any cost associated with accessing the competition or Flickr website is the entrant's responsibility and is dependent on the Internet Service Provider used.
27. The use of any automated entry software or any other mechanical or electronic means that allows an entrant or voter to automatically enter repeatedly is prohibited and will render all entries or votes submitted by that entrant invalid.
28. Except for any liability that cannot be excluded by law, the Promoter and Yahoo!7 (including their officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's or Yahoo!7's control); (b) any theft, unauthorised access or third party interference; (c) any entry, photograph or prize claim or vote that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or Yahoo!7; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
29. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry and voting is conditional on providing this information. Unless otherwise advised, The Promoter will, for an indefinite period, unless otherwise advised by an entrant, use the entrant's personal information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants or voters should direct any request to access, update or correct information to the Promoter.
30. Yahoo!7 reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and select winners from among all eligible entries received prior to the cancellation.
31. The Promoter reserves the right to alter these terms and conditions, withdraw any prize from the Promotion or alter or cancel all or part of the Promotion in its absolute discretion without notice.
